Residence Requirements:

Either spouse must be resident of Florida for 6 months before filing for divorce.

 

Grounds for divorce:

Irretrievable breakdown of the marriage, or

mental incapacity for 3 years (supported by documentation).

 

Mandated mediation  or counseling:

Required if there are children involved, or

If one spouse disputes that the marriage is irretrievable broken.

 

Property distribution:

Florida is a equitable distribution State.  After the divorce, each spouse retains his or her separate property.  Such property  is said to be "separate property"  if it  was  acquired  before the marriage, or acquired  by gift  or inheritance,  or property  divided by written agreement (Marital Settlement Agreement) between the spouses.

 

Alimony/Spousal support /Maintenance:

Either spouse may be awarded alimony,  on either a permanent or rehabilitative basis.

 

Child custody and visitation:

Either  parent  may be  awarded  custody  of  the minor  children.  Either parent may be  ordered  to pay  child  support  according to the amount stated in the Florida State guidelines.

 

Rights to maiden name:
